Riasakami coffee factory manager from Keera Location in Nyamira County has been charged for defilement before Nyamira Law Courts.

George Morara Basweti, 51, appeared before Resident Magistrate Beniah Okongó on Monday charged with defilement of a 5-year-old minor contrary to section 8 (1) as read with section 8 (2) of the Sexual Offences Act No.3 of 2006.

He was further charged with an indecent act contrary to section 11 (A) of the Sexual Offences Act No.3 of 2006.

The court heard that on the 17th of May 2013 at around noon, the accused person waylaid a five your old minor who was headed home, diverted her to a tea plantation at Charachani sub location and defiled her.

The matter was reported on 18th of May, 2023 and he was arrested by officers from Nyamira South Sub County Police station on 20th may 2023.  

While giving his report, the Nyamira South Sub-County Children Officer Billy Adera   requested the court to give an exclusion order to the accused person.

He explained that the accused person was a neighbour to the complainant and a very influential person in the community who could likely interfere with investigations by compromising and or threatening the complainant and witnesses of the case.

Adera therefore requested the court to issue an exclusion order which could bar the accused person from getting in touch with the complainant or any of her close family members for the entire period the matter would be ongoing in accordance with section 135 (c) of the Children’s Act of 2022.

The court granted the children officer’s request and ordered the accused person to comply.

When granted permission to speak after pleading not guilty to the defilement charges, Basweti requested the court to release him on bond and vowed to comply with all the orders of the court while the matter is ongoing because he is his family’s breadwinner.

The court declined his request and the magistrate ordered that a pre-bail report be presented before court on 7th June, 2023 to determine whether he was fit to be released on bond.

The hearing of the case was scheduled for 10th July, 2023.
