A Loitoktok law court has ruled that a grandfather who allegedly defiled his 3-year-old granddaughter, left under his care has a case to answer.
While making the ruling, Principal Magistrate Judicaster Nthuku found George Kuria Njoroge liable for prosecution in a case where he allegedly defiled the minor on December 24, 2022 at Kangundo village in Loitoktok Sub County.
While testifying before the court, Naomi Wairimu, grandmother to the child, said on the material day she left the girl under the care of her husband and proceeded to the market.
However, when she came back at around 7.00pm, she found the girl sleeping on a couch and took her to bed and the following morning found she was in bad health and ate very little.
Later on, the girl went to her grandmother's bedroom, complaining of pain in her private parts and upon enquiry she revealed how the accused defiled her and threatened to kill her if she revealed the matter to anyone.
Shocked, Wairimu confronted the accused who became violent and started acting like a mad person before the girl was taken to Loitoktok police station where the matter was reported.
She was also taken to Loitoktok Sub County Hospital for medical examination where she was found to have been badly damaged in her private part.
The accused was later arrested and escorted to police station, where he was charged with the offence, before being arraigned in court where he denied the allegations.
The matter was set for defence hearing on June 8, 2023.
