A Loitoktok law court has committed a 17 year old boy to a borstal institution for three years for defiling a five year old minor.
Jonathan Ngomi was committed to Shimo la Tewa borstal institution by Principal Magistrate Judicaster Nthuku.
Ngomi was found guilty of the charge that on January 23, 2023 at Ilasit village in Loitoktok Sub County he defiled the minor.
Mercy Njeri, mother to the minor, told the court that on that particular day she left her daughter at home as she went to work. The court heard that the minor did not go to school because she had a toothache.
She told the court that as she was bathing her daughter in the evening, the daughter started screaming in pain.
When the mother enquired what was wrong, the minor told her that she went to the accused person’s house during the day and that the accused defiled her.
Immediately Njeri and her neighbour went to Ngomi's place but missed him.
The girl told the court how on the material day after her mother left she went to the accused house and he laid her on a couch and defiled her.
The following day the matter was reported at Ilasit police station while the minor was taken to a nearby health centre for medical examination.
Later the police in company of Njeri and the girl went to the house of the accused and arrested him and escorted him to police station where he was charged with the offence before being arraigned in court where he denied.
In his defence the accused denied committing the offence saying on the material day he spent the day at his friend's place only to be arrested the following day.
However, the court found that the prosecution had proved the case beyond reasonable doubt.
