A Loitoktok law court has found a 17-year-old boy guilty of defiling a five-year-old girl.

Jonathan Ngomi who appeared before Principal Magistrate Judicastor Nthuku was found guilty of a charge that on January 23, 2023 at Ilasit village in Loitoktok Sub County, he defiled the five-year-old girl.

According to Mercy Njeri, mother to the girl, on that particular day, she had left her daughter at home while going for work after she failed to go to school because of a toothache.

When she came back and as she was bathing her daughter in the evening, the child started screaming and upon enquiry from the minor, the girl told her during the day, she had gone to the house of the accused where he defiled her.

Immediately Njeri and her neighbour went to Ngomi's place but missed him.

The girl told the court how on the material day after her mother left, she went to the accused person’s house and he laid her on a couch and defiled her.

The following day, the matter was reported at Ilasit police station while the minor was taken to a nearby health centre for medical examination.

Later, the police in company of Njeri and the girl went to the house of the accused, arrested him, escorted to the police station and charged him with the offence then arraigned him in court where he denied the charge.

In his defence, the accused denied committing the offence saying that on the material day, he spent the day at his friend's place only to be arrested the following day.

However, the court found that the prosecution had proved the case beyond reasonable doubt and the matter was set for sentencing on May 29 pending pre-sentencing report.
