An alcohol dealer fined Sh 100,000 for operating without license

A middle-aged man in Baringo County was on Wednesday fined Sh 100,000 by a Kabarnet court for supplying liquor without an alcoholic license.

The accused, Kevin Kandie, was found distributing 20 cartons of 250 ml of best Gin Brand, on June 6, 2023 at around 8:30 pm at Kator area along Kabarnet-Kabartonjo road in violation of Section 64 of the Baringo County Alcoholic Beverage Control Act 2014.

Police officers who were on their daily routine duty of inspecting vehicles plying along the best route arrested the driver after flagging down the car upon discovering that the Toyota Probox under registration number KCM 407M was loaded with alcoholic drinks but the owner could not produce the required alcoholic distribution license.

The accused who appeared before Senior Resident Magistrate Purity Kosgei pleaded guilty to the offence levelled against him.

In mitigation, the accused requested for leniency claiming that he is the sole provider for his tender vulnerable young family.

In his submission, prosecution counsel Joseck Abwajo informed the court that the accused had no previous criminal record thereby indicating that he is a first-time offender.

Delivering her ruling, the magistrate ordered the accused to pay a fine of Sh 100,000 in default serve one year in prison.

However, she granted him 14 days of appeal.
