Man, 35, to serve 2 years in jail for theft

Makueni law court has sentenced a 35-year-old man to two years in prison for burglary and stealing items of worth Sh45,000.
Appearing before the Chief Magistrate Peter Gesora, Kelvin Mutinda pleaded guilty for breaking into a house and stealing property belonging to Joseph Mbindyo.
Mutinda committed the offence between September 16 to October 13 at Mukuyuni market, in Kaiti division, of Makueni County.
He stole 90kg dry maize, 20kg dry beans, shock absorber rings, 2 size 15 tyre and rim and three-seater car seat.
Other items included, one sack of charcoal, 2kgs of sugar, one packet of tea leaves, 2kg packet of unga, three litres of cooking oil, basket, two pairs of open shoes, one bar soap all belonging to Mbindyo.
The court heard that, the accused was found with wearing stolen long trouser and a pair of sandal shoes at the market on 14th October around 11 pm in night.
In his mitigation the accused pleaded for leniency saying that it was his first offence and he won’t repeat.
"I have carefully considered the plea by the convict who is a first-time offender and I therefore sentence him to serve two years," Gesora. The accused was given 14days to appeal.
