Banisa constituency Member of Parliament (MP) seat has been declared vacant.

Moses Masika Wetang'ula, National Assembly speaker declared the seat vacant, weeks after the death of former MP Kullow Maalim Hassan.

The speaker declared the seat vacant through a notice in the Kenyan gazette.

“Pursuant to Articles 101 (4) (a) and 103 (1) (a) of the Constitution as read with section 16 (3) of the Elections Act, 2011, it is notified for the general information of the public that the seat of the member of the National Assembly for Banisa Constituency elected under Article 97 (1) (a) of the Constitution has become vacant with effect from the 29th March 2023,” reads the notice.

The declaration now paves way for the Independent Electoral and Boundaries Commission (IEBC), to conduct a by-election in the constituency within 90 days.

Kullow Hassan Maalim died about a month ago, following an accident in Nairobi.

The legislator succumbed to injuries sustained after he was hit by a speeding motorcyclist in South C.

Maalim was serving his second term in office.
