Bungoma father to appear in court for alleged abduction of his son, daughter

The academic life of Lavin Nekesa and Fabian Simiyu has been temporarily cut short after secretly being abducted by their own biological father from Sang’alo junior academy.
Their mother Adeline Syombua Silah who cohabited with Douglas Watitwa was in 2018 chased from the matrimonial home and to date stays with her parents, where her minors have been under her custody.
Adeline claims in a written affidavit that in March 2023, Douglas secretly took Lavine Nekesa who was a candidate at Sang’alo junior academy and later on 8th June 2023 he also secretly took Fabian Simiyu out of school to unknown places.
She also added that the minors were abandoned at the defendant’s concubine, as his nature of work does not allow him to take care of the children, since he is a police officer.
Adeline engaged with the Children’s officers, who summoned the defendant to appear and negotiate on terms of custody but he remained adamant and failed to show up
The mother of two is currently worried that the minors are not yet admitted to another school and their education is likely to be interfered with.
“I am fearful if this continues, their studies will be greatly affected unless this honorable court intervenes,” the plaintiff stated.
The alleged police officer is said to be a dead-beat dad as he does not take parental responsibility over his children forcing the mother to pay medical bills and school fees.
In addition, Adeline is seeking the immediate return of the minors to Sang’alo junior academy, and payment of fees from primary to university level going forward
On June 13, 2023, Adeline signed an affidavit stating that, the defendant be compelled by Bungoma Law Courts to immediately put the minors herein on his medical cover and to immediately contribute Sh35000 as maintenance fee for the minors.
The defendant is set to appear in the Bungoma court on July 7, 2023 before Principal Magistrate Ezra Ayuko for hearing, failure to which, the plaintiff, Adeline, may proceed with the suit and judgment may be passed in his absence.
