DCI file to detain Boniface Mwangi, 4 others, 21 more days

The DCI has filed for an order to detain in activist Boniface Mwangi and fourth others for 21 days at the Central Police station, pending investigations to charges of unlawful assembly and incitement of chaos. 

"That this honorable court be pleased to issue custodial orders authorizing the holding of the respondents by the applicant, through its investigations at the Central Police station for a period of twenty one (21) days to enable the completion of the investigation into the offenses of false publication contrary to section 22(1) of the computer Misuse and cyber crime Act

Taking part in unlawful Assembly contrary to section 78(1) and 79 of the penal code and creating a disturbance in a manner likely to cause a breach of peace contrary to section 95 (1) (b) of the penal code. "The motion read. 

Boniface Mwangi and the Co-accused Robert Otieno, Albert Wambugu, Pablo chacha and Erot Franco were arrested on Thursday, 25 July, 2024 along Koinage street at the Nairobi CBD amongst hundreds of other Anti - Government protestors who demanded justice for the Kenyans killed by police during protests and release of abducted protestors.

Upon their arrest, the five were found in possession of a white coffin and seven white crosses with names inscribed on them. 

The DCI says that the five amongst other protesters caused a breach of peace during the event of their protests and blocked other road users from accessing the CBD. 

The five are also accused of distributing white T-shirts with incitement words to other protestors as well as using their social media platforms to incite others that the government had perpetrated extra Judicial killings, henceforth disturbing peace. 

The five were booked at the Central Police station upon arrest, pending investigations into the motive of their actions and the financer of the protests. 

Their mobile phones were also confiscated to aid in investigations. 

The DCI believes that the white coffin and crosses were funded by an unknown person. 

The motion seeks for custodial orders of the five at the Central Police station for 21 days warning that their release will jeopardize investigations.
