A Kabarnet court has released a defilement suspect from Baringo South on a Sh 300, 000 bond with one surety of a similar amount.

Jefferson Soite appeared before Kabarnet Senior Principal Magistrate Purity Kosgei charged with defilement contrary to Section 8 (1) as read with Section 8 (3) of the Sexual Offences Act No. 3 of 2006.

Soite also faced the second charge for committing an indecent act with a child in violation of Section 11 (1) of the Sexual Offenses Act No. 3 of 2006.

The charge sheet stated that the accused intentionally defiled a 10-year-old girl between December 27, 2022 and July 28, 2023, at the Zike village of Illng’arua Location in Marigat sub-county within Baringo County.

The defilement case was reported at Marigat police station on July 28, 2023, and the accused was detained and taken to Marigat Police Station before being arraigned in court.

The accused pleaded not guilty to the charges leveled against him. In his defense, he requested the court to have the complainant taken for an age assessment.

Prosecutor Mr. Joseck Abwajo provided the treatment note, ultrasound request form, birth certificate and age assessment document.

The Magistrate ordered the accused to be released on a Sh300, 000 bond with a surety of a similar amount pending the hearing and determination of the case.

She said that because the accused has been provided with a birth certificate for the complainant, age assessment will not be needed in the circumstances until a later stage.

Kosgei set the hearing date to be August 10 this year which is likely to be a convenient day because that would be a school holiday.
