Mama Ngina Kenyatta in court over Taveta land
By Peter Ochieng
Former First Lady Mama Ngina Kenyatta has moved to court over ownership of a piece of land in Taita Taveta county.
She filed the case alongside former Taveta Member of Parliament (MP) Basil Criticos, to push for ownership of the land measuring 1062.3 hectares.
The duo have sued chief lands registrar and the Attorney General, claiming that they have failed to issue them with a certificate of title for the land.
“The applicants are the joint operators and owners of the parcel of land known as LR No. 10287/7Taveta," reads court papers in part.
“It is now over one year since the property was registered under the provisions of the land registration act, and the registrar has failed to issue to the applicants the said certificate of title,” argues the two applicants.
Ngina Kenyatta and Criticos argue that lack of a certificate has denied them the right to hold the said certificate, as evidence of proprietorship of their said parcel of land.
“The registrar is the custodian of the said documents and is the only person to explain why the applicants have been denied their said certificate of title."
They now want the court to compel the lands registrar to issue them with the original certificate of the title land reference LR No. 10287/7 Taveta, insisting that they are the registered owners of the said land.
The matter has been satisfied as urgent. The matter will be mentioned on March 05, 2023.
