Eldama Ravine Senior Principal Magistrate Richard Koech has today released a man suspected to have stolen a lawn mower worthy Sh10, 000 cash bail.
Philip Memusi, a resident of Kaprangi, Koibatek Sub County in Eldama Ravine, will enjoy his freedom as he awaits the sentence to his case after he pleaded guilty to the charges levelled against him.
Memusi was charged of stealing a lawn mower that is worth Sh65,000, property of Robert Kipng’eno at around 4 pm on June 12, 2023.
Robert Kipng’eno who works for a man named Caleb as a caretaker received a call from his employer telling him that the accused was seen trying to sell his lawn mower in Eldama Ravine town.
Robert went ahead and reported to Eldama Ravine Police Station so that they could take action before the accused completed the sale transaction.
The officers tracked the accused person, arresting him and placing him in custody together with the lawn mower he was trying to sell as the exhibit.
In his mitigation and while asking for forgiveness, Memusi told the court that he had taken the lawn mower to seek work, “because with the current economy, life is hard and the mistake that I did was taking it without informing the complainant”.
In her response, State Counsel Vena Adhiambo asked the court to treat the suspect with reasonable leniency since he was a first time offender.
The magistrate set the sentencing for June 21, 2023 upon which he will have received a probation report on the accused.
“If he will not be able to pay the cash bail, he will be remanded in Eldama Ravine GK prison,” ordered the Magistrate.
