Moses Kuria reveals what he’ll do if Supreme Court passes BBI

Gatundu South MP Moses Kuria has weighed in on the BBI ruling set to be released today by the Supreme Court, noting that if a positive verdict is delivered, he will back the constitution amendment push. According to Kuria, the ruling will provide clarity in regards to proposals made by BBI proponents regarding various issues including introduction of new positions in the executive. “The problem with BBI was never solely the substance; it was the process. The net effect of the Supreme Court ruling today will be a remedy to all the process maladies. If the SC rules in favour of BBI, that will cleanse the process. I will be at the forefront in pushing for immediate implementation,” he posted on Facebook. Kuria’s statement marks a change of heart as he is one of the leaders who boldly rejected the BBI Bill, arguing that Kenyans should not be subjected to a referendum before the 2022 general election. The case made its way to the Supreme Court after the High Court and the Court of Appeal trashed the BBI Bill terming it unconstitutional due to several issues including lack of public participation. Some of the issues expected to be addressed by the Supreme Court include; whether the president has powers to initiate a popular initiative, whether public participation was conducted in the BBI process, and lastly, whether he lower courts erred in finding the BBI process illegal, null and void. Whether the court rules in favour or against the bill, the ruling is expected change the political landscape in the country as we head into the August 2022 general election.
