Petition filed to block Sonko from contesting Mombasa gubernatorial seat

A petition has been filed in court seeking to block former Nairobi Governor Mike Sonko from contesting the Mombasa gubernatorial seat ahead of the August 9, 2022, General Election.

In the petition, Ndoro Kayuga and George Odhiambo argued that Sonko is disqualified from holding public office, following his impeachment.

“The 1st Respondent, having been impeached and removed from the office of the Governor of Nairobi City County, is disqualified from vying for and being elected into the office of the Governor of Mombasa County and from holding any other State office by virtue of Article 75 (3) of the Constitution,” the petition reads in part. The petitioners further claimed that Wiper subverted provisions of the Constitution of Kenya 2010 by nominating Sonko.

“The 1" Respondent and the 1st Respondent's decision to accept the nomination despite being disqualified by the Constitution is in violation of the Petitioners' constitutional rights to free, fair and regular elections as guaranteed by Article 38 (2) of the Constitution,” further reads the petition.

The petitioners want the court to issue orders barring IEBC from clearing Sonko to contest in the upcoming elections.

They argue that Sonko will not suffer any prejudice if barred from vying.

Sonko was impeached by the Nairobi County Assembly in December 2020 on allegations of gross misconduct and abuse of office.

The former Nairobi Governor will fly the Wiper Party flag in the Mombasa gubernatorial contest and will be deputized by Kisauni MP Ali Mbogo. Sonko is expected to face off with ODM's Abdulswamad Nassir and UDA's Hassan Omar.
