Kisii County Police Commander Mr. Charles Kases has clarified that the suspect who defiled a 5-year-old girl at Magena Center in Kenyenya Sub County is under police custody.

According to Kases, the 30-year-old man identified as Mark Manono was arrested on January 21, 2024, and detained at Magena Police Station after it was reported that he had committed the offence.

He noted the suspect fell ill while in custody and was rushed to Ogembo Sub County Hospital, and later referred to Kisii Training and Referral Hospital (KTRH) for further treatment.

Kases said the suspect was later presented before the Principal Magistrate Calestous Sindani at Ogembo Law Courts on January 23, 2024, after being discharged.

The Police Commander noted that Manono pleaded not guilty to the charge of defilement contrary to Section 8 (1) as read with Section 8 (2) of the sexual offenses Act No. 3 of 2006 and the second count of committing an indecent act with a minor contrary to Section 11 (1) of the sexual offenses Act No. 3 of 2006.

He added the suspect was remanded at the Kisii Main Prison and the case would be mentioned on February 6, 2024.

The Police Commander was responding to claims circulating on social media suggesting that the accused had colluded with the police to prevent the arrest of the perpetrator of the crime.

Kases affirmed that the police are committed to performing their duties without favoring parties or taking any case for granted.
