Man to pay Sh 100, 000 bond for trafficking bhang

A Kabarnet court has slapped a man from Baringo County has given a man who was found trafficking in cannabis sativa (bhang) a Sh 100,000 bond with one surety after he denied the charge.
Asman Kibet alias Assu appeared before Senior Resident Magistrate (SRM) Edwin Mulochi charged with being in possession of narcotic drugs contrary to Section 4(1) as read with Section 3(1) of the psychotropic drugs and substances contract Act No.4 of 1994.
The accused was charged that on October 2, 2023 at about 12:35am at Kabarnet town in Baringo Central sub-county, Kibet was found in possession of Sh 20,000 worth illicit substances being 20 rolls of bhang.
The accused was also charged with resisting a lawful arrest by police officers contrary to Section 253 (b) of the Penal Code.
The court was told that when the police officers wanted to arrest him, he willfully resisted and obstructed police officers who were acting in the due execution of their duties.
When the charges were read to him on Tuesday, he vehemently denied engaging in such illegal activity nor ever resisting arrest.
“Your honour, I was not owning bhang and neither did I decline the police officers’ orders,” said the accused person in his defense.
Mulochi in his ruling ordered the suspect to be released on Sh 100, 000 bond plus one surety or an option of Sh 30, 000 cash bail.
The case will be mentioned on October 13, 2023 pending its hearing set to commence on November 11 this year where three witnesses are expected to testify.
