Man accused of defilement released on Sh300,000 bond

Eldama Ravine Resident Magistrate Alice Towett has released Daniel Wamalwa Ochwek, accused of defiling a 14-year-old girl on Sh300,000 bond.
The accused first appeared in court on the 27th day of June 2023, where he was charged with defilement contrary to section 8 (1) as read with section 8 (3) of sexual offenses Act no. 3 of 2006.
The accused was also charged over an indecent act with a child contrary to section 11 (1) of the sexual offense Act no.3 of 2006 and pleaded not guilty to both charges.
The particulars of the case are that Ochwek on the 21st day of June 2023 at Tinet village in Koibatek sub-county within Baringo county defiled‘’MJ” (not the real name) a child aged 14 years and also engaged himself in an indecent act with the minor.
The minor had been sent by her mother to fetch firewood, when the awful incident occurred. The minor returned home and informed the mother of what had happened.
She was taken to Eldama Ravine sub-county hospital where she was examined and the doctor confirmed that the incident had actually happened.
She later reported the matter to Eldama Ravine police station and police started a search of the accused and arrested him on the 26th day of June 2023.
The prosecution had earlier prayed that the accused be denied bond during the first mention as the release of the accused will interfere with their investigations.
The magistrate ordered that in the event the accused fails to raise the bond, he should be taken into custody at Nakuru GK prisons and the case to be mentioned on 26th July 2023.
