Man who assaulted supervisor on suspicion of a lover affair to be sentenced

An Eldama Ravine Court has put to defence a quarry worker who assaulted his supervisor for suspecting he was having an affair his wife.
Senior Principal Magistrate, Richard Koech slated the sentencing for June 27, 2023 after Bethwel chirchir pleaded guilty of assaulting Collins Kirwa and causing him actual bodily harm.
According to the charge sheet, on June 3, 2023 at around 1200 hours in Kipsogon village, Mogotio, Baringo county Bethwel Chirchir hit Collins Kirwa and caused actual bodily harm.
The particulars of the case read that Collins Kirwa was together with fellow workers at summer rose quarry carrying on with their daily activities. The accused arrived late and when he was asked about it by the complainant he immediately attacked him using a claw bar.
He hit him on the head and tried to run away but he was caught by the other workers before he could get out of the quarry premises.
Collins was taken to Mogotio Sub-County Hospital and later to Glory Hospital because he was bleeding. An x-ray was done and he received other treatments.
It is alleged that Chirchir assaulted Kirwa for suspicion that the later was having an affair with his wife.
State Counsel Vena Adhiambo produced p3 form, treatment notes, x-ray of the skull, two photos showing the injuries, a claw bar, and blood-stained clothing’s as exhibits.
In his mitigation, Bethwel told the court to forgive him as he has children and he is the sole breadwinner.
Magistrarte Richard Koech set the case for sentencing on June 27, 2023 upon which he will have received a probation report on the accused.
