A pharmacist and an intern arraigned before a Kabarnet court charged with stealing assorted drugs and medical supplies have been released on a personal bond of Sh 100,000 each with one surety of a similar amount.
The first accused Victor Bosire was charged with stealing by servant contrary to section 281 of the penal code, while Kenneth Kipruto was charged with stealing contrary to section 268 (1) as read with section 275 of the penal code.
Kipruto also faced an alternative charge of handling stolen property contrary to section 322(1) of the penal code.
According to the charge sheet, Bosire, a servant of Baringo County Referral Hospital stole one (1) METFORMIN 500 Mg drug valued at Sh 5000 on July 24, this year at around 11 pm at the county referral hospital, Kabarnet in Baringo Central sub-county.
The court heard that on July 24, this year, Kipruto stole assorted medication worth Sh 5,000 from the Baringo Referral Hospital and other than stealing, dishonestly handled or maintained various medicines valued at Sh 5000, property of the said health institution.
When the duo appeared before Senior Resident Magistrate Edwin Mulochi they both denied committing the offences levelled against them. Defense lawyer Solomon Chepkilot prayed the court to grant his clients reasonable bond terms, saying they would adhere to all the conditions set.
The prosecution Counsel Rebecca Bartilol in her submissions requested the court to prohibit the two from accessing the hospital’s pharmacy which she said remains a scene of crime.
“There are some documents which the investigating officer has to obtain from the pharmacy and we are requesting they be barred from entering the said place,” Bartilol explained.
Mulochi ordered the accused to be released on Sh 100,000 bond each with one surety or alternative cash bail of Sh 50,000 each. He, however cautioned the accused against intimidating or bribing witnesses noting that it can result in cancellation of their bond terms.
The Magistrate directed the case to be mentioned on August 10 and the hearing to be on October 4 where five witnesses are lined up to testify.
