A 17 year old juvenile charged with attempting to defile a 4 year old minor in a bathroom yesterday denied the offence and instead said he was just helping the minor.
The accused is charged with attempting to defile the minor on 31st, March this year at Entarara market, Loitoktok Sub County.
According to the victim’s mother, on the material day, around 2.00 pm the minor’s sister rushed into the house saying her sister was being defiled by the accused at their bathroom.
Ndunge said she rushed out towards the bathroom only to find the accused running away.
The minor's sister had told the court how she saw the accused call the complainant and led her to the bathroom.
She said she followed them and saw the accused lowering his trouser following which he undressed and attempted to defile the minor. She said on seeing her (the witness) he put on the trouser and vanished.
The complainant on the other hand said the accused indeed removed her inner wear and defiled her.
The girl was taken to a hospital at Entarara for medical examination before the matter was reported at Entarara police post. Medical report indicated there was no evidence of defilement.
Following the incident, the accused allegedly went into hiding for two days and then resurfaced whereby he was immediately arrested and charged with the offense.
In his defense the boy said he found the girl struggling to remove her inner wear for a long call and decided to help and in the process her sister saw him and he ran away.
However, Loitoktok Principal Magistrate Ms Judicaster Nthuku found out that the prosecution had proved the case beyond reasonable doubt and said she will deliver her verdict on 9th of this month.
